In Vol. 16, No. 11 of the NATIONAL GUARDIAN, the progressive newsweekly, published on December 19, 1963, Mark Lane, attorney and author of the book Rush to Judgment, wrote a piece entitled Oswald Innocent?—A Lawyer’s Brief; A Report to the Warren Commission.”

In an analysis of the civil liberties aspects of the assassination of Lee Harvey Oswald by Jack Ruby, the American Civil Liberties Union said the “public interest” would be served if the commission formed by President Lyndon Johnson were to make “a thorough examination of the treatment accorded Oswald, including his right to counsel, the nature of the interrogation, his physical security while under arrest, and the effect of pretrial publicity on Oswald’s right to a fair trial.”
